Common Cadre Rules

THE PUNJAB STATE COOPERATIVE FINANCING INSTITUTIONS SERVICE

(COMMON CADRE) RULES, 1970-71.

1.1       SHORT TITLE 

These rules shall be called the Punjab State Cooperative Financing Institutions Service (Common Cadre) Rules, 1970-71.

1.2       COMMENCEMENT

These rules shall come into force immediately.

1.3       DEFINITIONS

In these rules, unless the context requires otherwise:-

a)    ‘Apex Bank’ means the Punjab State Cooperative Bank Ltd.

b)    ‘Board’ means the Board of Directors of the Punjab State Cooperative Bank Ltd.

c)    ‘Administrative Committee’ means the committee constituted in pursuance of clause 1.4 of these rules.

d)    ‘President/Chairman’ means the President/Chairman of the Punjab State Cooperative Bank Ltd.

e)    ‘Managing Director/Addl. Managing Director/General Manager’ means the Managing Director/Addl. Managing Director/General Manager of the Punjab State Cooperative Bank Ltd.

f)    ‘Government’ means the Government of Punjab.

g)    ‘Registrar’ means the Registrar, Cooperative Societies, Punjab or his nominee not below the rank of Deputy Registrar nominated by him in this behalf.

h)     ‘Central Bank’ means a Central Cooperative Bank registered in the State of Punjab under the Punjab Cooperative Societies Act.

i)     ‘Direct recruitment’ means the appointment made otherwise than by promotion from within the service or by transfer on deputation.

j)     ‘Equivalent Posts’ means any two or more posts on the service carrying identical time scale.

k)     ‘Salary’ means the basic monthly pay inclusive of any other emoluments treated as pay.

l)      ‘Family’ means wife, dependent minor sons and dependent minor unmarried daughters.

1.4              AUTHORITY TO IMPLEMENT THESE RULES

  a)             These rules shall be administered by a committee constituted by the Board (referred to as Administrative Committee).  The provisions of bye-laws 41, 42,  
43 and 44 of the Punjab State Cooperative Bank Ltd., Chandigarh shall ‘mutatis mutandis’ apply in the matter of constitution, quorum, meeting,                    powers of the Administrative Committee and dissent by the Registrar or his nominee.

Provided that the term of the Administrative Committee once constituted shall be co-terminus with the Board of Directors.  Any vacancy occurring during the tenure of the Committee shall be filled in for the un-expired period only.

Provided further that in case there is no Administrative Committee, on account of any reasons whatsoever, the Managing Director, Addl.Managing Director (Admn) of Apex Bank and the Addl.Registrar, Cooperative Societies (Credit) shall jointly exercise all powers vested in and discharge all duties cast on the Administrative Committee as mentioned in the Punjab State Cooperative Financing Institutions Service (Common Cadre) Rules 1970-71.

b)          One third of the total members or three whichever is more shall form quorum for every meeting of the Administrative Committee and at least seven days notice shall be given for such a meeting  except that the meeting may be called on a shorter notice with the prior sanction of the Registrar, Cooperative Societies.  All decision shall be taken by majority of votes in case of equality of votes the Chairman shall exercise an additional casting vote.

Provided that in case the Registrar, Cooperative Societies, Punjab or his nominee gives a note of dissent the matter shall be referred to the Board for decision by the Managing Director/Addl.Managing Director(Admn) in the next meeting of the Board.

c) The Administrative Committee shall be competent to delegate any of its powers to any member of the Committee/official of the Bank if considered necessary

1.5              PURVIEW

a) These rules shall apply to employees of Central Cooperative Banks and Apex Bank included in the Common Cadre listed in Note II attached with Annexure I.

Provided further that in case of the employees appointed by transfer on deputation, these rules shall apply only to the extent specified in their term and conditions of deputation agreed upon with the competent authority of Government or parent institution concerned.

1.6              CONTROL OVER THE EMPLOYEES IN COMMON CADRE

All the employees in Common Cadre shall be deemed to be in the service    of Common Cadre created in the Apex Bank.

1.7              CATEGORISATION OF EMPLOYEES IN COMMON CADRE

a) The various categories covered by the Common Cadre and the salary scales of each of the category of posts shall be as specified in Annexure I.

Provided that the Board of Directors of the Apex Bank may add or delete any category of posts or add or delete posts in any category and specify the number of selection grade posts in each category of posts or revise the scale of pay given in Annexure I and fix the qualifications for recruitment to new categories with the approval of Registrar, Cooperative Societies in all such cases.

1.8              SALARIES OF STAFF STRENGTH

Salaries of employee of the Apex Bank and Central Cooperative Banks of categories specified in Annexure I on the basis of the criteria for fixation of salaries for the employee of the Government.

1.9              CREATION OF STAFF STRENGTH

a) The existing staff strength of Apex Bank and Central Cooperative Banks of categories specified in Annexure I shall provisionally be considered the strength of the Common Cadre.

b)           All the employees included in the categories in Annexure I shall provisionally be deemed to be on the strength of the Common Cadre but shall draw their salaries  in their respective old pay scales till finality selected by the Administrative Committee on the strength of the Common Cadre. Such employees who are finally selected on the Common Cadre by the Administrative Committee shall be entitled to draw their pay on the basis of the pay fixed by the Administrative Committee in the pay scales provided in the Annexure I from the date of enforcement of these rules.

c)           The Administrative Committee shall determine the strength of temporary/substantive posts for the Common Cadre for the Punjab State Cooperative Bank and for the Central Coop.Banks on the recommendation of the Board of Directors of the concerned bank subject to the approval of the Registrar, Coop.Socs.  The Administrative Committee may from time to time make and change in the sanctioned strength of different categories of posts in the Common Cadre with the prior approval of the Registrar, Cooperative Societies.

1.10          INTEGRATION OF EMPLOYEES

a)       The integration of existing employees of the Apex Bank and Central Coop.Banks in the categories of posts given in Annexure I shall be done by the Administrative Committee after satisfying the suitability of employees for the posts.  The Administrative Committee will be guided, inter alia, mainly by the following factors for conducting the screening of an employee for this purpose.

i)          That his appointment including promotion to the post held by him before taken in Common Cadre was approved by the competent authority.

ii)         That he fulfils the minimum qualifications, which were applicable to the post at the time of recruitment.

iii)        That his previous record of service was satisfactory.

b)         The seniority of employees who are taken on Common Cadre under the provisions of these rules shall be determined in a particular category on the basis of his qualified length of service on the posts held at the time of enforcement of these rules.  Provided that the employees working in the high grades just before the enforcement of these rules  shall be deemed to be senior to the employees working in lower grade in the same category.  The qualified length of service shall include the continuous officiating period of service on the posts in the category.

c) If the date of joining is the same in case of two or more employees against equivalent posts, their interse seniority shall be determined according to the age, the older being the senior and if in case of such employees the date of birth of any two or more employees is also the same, the inter se seniority shall be decided by the Administrative Committee whose decision shall be final.

1.11          FINANCIAL LIABILITIES OF THE APEX BANK/CENTRAL COOP.BANKS TOWARDS THE SERVICE.

a) The salary for the period of duty including all allowance shall be paid to the employees in Common Cadre by the Apex Bank or by the Central Cooperative Bank for which the duty is performed.

b) For the period of leave other than casual leave, the leave salary along with allowance shall be paid by the Apex Bank.

c)         The Central Coop.Banks concerned shall pay to the Apex Bank contributions in respect of the leave salary inclusive of all allowances, provident fund and gratuity and bonus at the rates intimated from time to time by the Administrative Committee.  The Apex Bank shall maintain Leave Salary Contributions Fund and Gratuity Contributions Funds for the contributions received from the Central Banks and contributed by the Apex Bank itself and these funds shall be administered by the Addl.Managing Director(Admn)/Managing Director.

d)            On transfer of an employee from the one Central Cooperative Bank to another Central Cooperative Bank or Apex Bank to Central Coop.Bank or vice versa the transfer travelling allowance and joining time salary shall be paid by the Central Bank or the Apex Bank, as the case may be to which the employee has been transferred.

e)         During the period of any training to which an employee is deputed by the Apex Bank, the salary allowances, stipend TA etc. shall be paid by the Apex Bank.  These expenses shall ultimately be shared by the Central Coop.Bank or Apex Bank itself in which the employee will remain on deputation during 36 months subsequent to training. Such expenditure will be reimbursed by the banks concerned to the Apex Bank

f)          In case of any doubt or dispute as to whether a particular period of duty relates to one Central bank or another or the Apex Bank.  The matter shall be decided by the Administrative Committee whose decision shall be final.

II

APPOINTMENT OF EMPLOYEES IN COMMON CADRE

AND

GENERAL CONDITIONS OF THEIR SERVICE.

2.1              APPOINTING AUTHORITY

a)          The appointment of Addl. Managing Director (Banking)/General Manager/Deputy General Manager shall be made by the Board with the prior approval of the Registrar.

b)         The Managing Director shall make appointment either directly or by promotion to the posts in the Common Cadre other than that of the Addl. Managing Director (Banking)/General Manager/Deputy General Manager with the prior approval of the RCS.

2.2              GENERAL CONDITIONS RELATING TO APPOINTMENTS

The following general conditions shall apply to all appointments to the service.

a)           Only Indian Nationals displaced persons from Pakistan who have permanently migrated to India or subjects of Nepal, Sikkim or Bhutan shall be eligible for appointment to the service.

b)          No person shall be appointed to the service by direct recruitment if he is less than 18 years of age or more than 37 years of age.  Provided further that upper age limit shall be 42 years in case a candidate is a member of scheduled caste or already employed in the service of another Cooperative Institution.

However, the upper age limit for the candidates employed in the service of the Apex Bank and those employed in the service of Distt Central Coop.Banks shall be 47 years.

Provided further that the upper age limit in all the above cases shall be considered on the last date of submission of application form.

c)            No person shall be appointed unless he has been certified by an Officer not below the rank of Assistant Surgeon to be of sound constitution and medically fit to discharge his duties.

d)            No person shall be appointed to the service if he has previously been dismissed from the service of any Government Department or any other institution or has been convicted by a Court of Law, as a result of some act of dishonesty or moral turpitude.

e) No person shall be posted in a bank covered by these rules in which any of the directors or any other employee is related to him within the meaning of Rule 2(k) of the Punjab Cooperative Societies Rules of 1963.

f) If anybody is found indulging is corrupt practices or in cases involving moral turpitude, the employer shall have the right to dispense with his/her services.

g) The employees who pass CAIIB Part I examination shall be eligible for one increment and those employees who pass CAIIB Part-II examination shall be eligible for two additional increments.

            Provided further that the employees who have completed their pay  

            scales and have passed the said examination shall be eligible for the

            above increments in the master scale.

2.3              NATURE OF APPOINTMENT

a) An appointment may be made of any of the following natures :-

i)          Purely temporary (may be terminated within a period of three months without notice).

ii)         Temporary (may be terminated or made substantive subsequently).

iii)        Substantive.

b) Appointments to the various posts under different categories of the service may be made from the sources stated in Annexure-II in the percentage prescribed therein.

c)         In case the vacancies for which no percentage has been fixed for appointment by promotion or by direct recruitment the Administrative Committee shall have the right to decide whether a particular vacancy should be filled up by direct recruitment or by promotion or by transfer on deputation.

2.4              APPOINTMENT  BY DIRECT RECRUITMENT

a) The minimum qualifications for direct appointment for posts under a category shall be those as have been specified against that category in Annexure III. However, the Administrative Committee shall be competent to add any additional or preferential qualifications for post/posts under a category.

b)          The Managing Director shall fix the order of merit in the decision of selection and the appointment to the posts shall be made according to the merit list.  The inter se seniority among such recruits shall also be fixed on the order of merit.

2.5              APPOINTMENT BY PROMOTION

a) The appointment by promotion to the posts under a category shall be made from eligible employees working in lower category as specified in Rule 2.3(b) supra by selection on considering seniority and record of service.

b) For promotion to the post in the lowest category (i.e. Manager) in these rules the persons serving in the Apex Bank or Central Coop.Bank in a category just below these categories shall be considered for promotion by the Managing Director.  The Managing Director shall be guided by the service record, qualification-academic and professional and length of service of the employee in that category for promotion.

Provided that in case a new post is created in the lowest category of the post of Common Cadre in a bank such post shall be filled in from amongst the staff working in that bank outside the cadre.

c) If two or more employees are promoted by the Managing Director in a category on the same date, the seniority shall remain the same as in lower category.  In case two or more employees are promoted by the Managing Director to the lowest category in Common Cadre, the Managing Director shall fix the order of merit in the decision of promotion keeping in view the provisions of Rule 1.10 (b&c) supra.

d) Fixation of time limit of service for promotion from one rank to other

1.   From Manager to Senior Manager                  4   years as Manager

2.   From Sr.Manager to Distt.Manager/               4   yrs as Senior Manager

      Asstt.General Manager                                                                      

3.   From Distt.Manager/Asstt.General                 4 yrs as Distt.Manager            Manager to Dy.General Manager                           Asstt.General Manager

The above amendment will equally be applicable to the schedule caste/schedule tribes/backward class officials.

2.6              SENIORITY

i) The seniority shall be determined separately in each category as provided at Annexure-I Note II.

ii)     The seniority inter se of the employees of any category shall be determined by the dates of their continuous officiation or appointment in that category.

iii)    In case of two or more employees appointed on the same date, their seniority shall be determined as follows :-

a)     If the appointment is made in pursuance of Rule 2.4 then the seniority shall be determined according to the merit list.

b)     If the date of joining of two or more employees by direct recruitment and promotion is the same, the directly recruited employee/employees shall be deemed to be senior.

SENIORITY:

2.6 (A-1)

i)          The seniority of Managers, Senior Managers and Assistant General Managers after they successfully complete their probation period, shall be finalized from the dates of their continuous regular service, by the Managing Director, who is their appointing authority. Their seniority lists will be prepared after providing adequate opportunity to them. Any employee aggrieved by the decision of the Managing Director, may within 30 days from the date of receipt of communication, appeal to the Board of Directors. The appellate authority may, however, entertain any appeal within 60 days of the said date if appellant had sufficient cause for not submitting the appeal in time.

            The period of service, if any, on adhoc basis shall not count towards seniority.

ii)         Managers, Senior Managers and Assistant General Managers, aggrieved by the decision of the Board of Directors Under Rule 2.6 (a) (i) may, within 30 days of the communication of the decision, file a revision petition before the Registrar, Cooperative Societies, who may decide the same himself or refer it to any other officer not below the rank of Additional registrar, Cooperative Societies for decision.

2.6 (B-1)

i)          The seniority of Deputy General Managers, General Managers and Additional Managing Director (Banking), after they successfully complete their probation period shall be finalized from the date of their continuous regular serviced, by the Board of Directors, who is their appointing authority. Their seniority lists will be prepared after providing adequate opportunity to them. Any employee aggrieved by the decision of the Board of Directors, may, within 30 days from the date of receipt of communication, appeal to the registrar, Cooperative Societies, Punjab. The appellate authority may, however, entertain any appeal within 60 days of the said date if appellant had sufficient cause for not submitting the appeal in time.

ii)            Deputy General Managers, General Managers and Additional Managing Director (Banking) aggrieved by the decision of the Registrar, Cooperative Societies, Punjab under Rule 2.6 (b) (i) may, within 30 days of the communication of the decision, file a revision petition before the Financial Commissioner and Secretary to Govt. Punjab, Department of Cooperation, who may decide the same himself or refer it to any other officer for decision.

2.7       COMMENCEMENT OF SERVICE

Service shall be deemed to commence from the working day on which an employee reports for duty on any appointment.  If he reports for duty in the afternoon, the service shall be deemed to commence from the following day.

2.8       PROBATION

a)   Every person appointed in any category under Rule 2.3(ii) and (iii) in the Common Cadre by promotion or direct recruitment shall be required to be on probation for a period of one year from the date of appointment.

b)   The Managing Director may at their discretion, extend the period of probation by further period not exceeding one and half years.

c)   During the period of probation or extension thereof, an employee promoted from a lower post to a higher post may be reverted to the lower post by the Managing Director during the probation period without notice.

2.9       TRAINING AND EXAMINATIONS

a)    The Managing Director may depute any employee of the service to undergo any course or courses of training and/or pass the examinations connected with the Cooperative and General Banking, Cooperative and Banking Laws, Book Keeping and Accounts, Management and Financial Control, and other allied subjects concerning the business of the Cooperative Banks and member institutions.

b)    The employees deputed for training shall be required to execute a bond agreeing to remain in the service atleast three year after the date of completion of the training failing which he shall be liable to pay the expenses incurred by the Apex Bank or Central Bank.

c)    An employee who fails to successfully complete the training or to pass the examination prescribed for the category shall be liable to be debarred for further promotion, reverted or denied one or more further increments as may be decided by the Managing Director.

2.10          POSTINGS AND TRANSFERS

a)   The Managing Director shall be competent to post any employee in Apex Bank or any Central Bank or transfer any employee from one Central Bank to another Central Bank or Apex Bank and vice versa against any equivalent post.  Such transfer orders shall be put up to the Administrative Committee for information in the next meeting of the Committee.  Provided that the first appointment and post of the fresh recruits shall be made by the Administrative Committee.

In case an employee is drawing salary in higher or lower grade than post to which he is transferred he may be allowed personal grade by creating a special post and making the existing post supernumerary.

b) Employees except those taken on deputation from Government or any other institution when posted or transferred to any Central Bank shall not be entitled to claim any deputation allowance.

2.11          RECORD OF SERVICE OF EMPLOYEES

i) The record of service of every employee inclusive of accounts of all types of leave except casual leave shall be maintained or caused to be maintained by the Apex Bank, the service books as are prescribed for Government servants or as may be specifically prescribed by the Administrative Committee for this purpose and all the entries shall be confirmed by the officer or officers authorised by the Administrative Committee.

ii) The casual leave account shall be maintained by the Apex Bank or Central Banks to concerned employees in the Register which may be prescribed by the Administrative Committee.

iii) Annual character rolls and confidential reports shall be recorded in the proforma to be prescribed by the Administrative Committee for this purpose by authorities empowered by the Administrative Committee and shall be maintained by the Managing Director.  All reports shall be written and deposited with Managing Director within three months of the close of the cooperative year who shall within a period of two months convey the adverse remarks to the employee concerned.  An appeal against adverse remarks shall be made within 30 days from the receipt of such communication to the Managing Director, who shall place them before the Administrative Committee or any other officer to whom the powers delegated by Administrative Committee for decision.

Provided that such appeal in case of Addl. Managing Director (Banking)/General Manager shall be considered and decided by the Board.

2.12          SECURITY

The members of the service shall furnish security in favour of the Apex Bank as may be decided by the Administrative Committee for the post on the basis of the instructions issued by the Registrar, Cooperative Societies.

2.13          TERMINATION OF SERVICE

No employee shall be entitled to notice or salary and allowance in lieu thereof if he is removed from service.

a)      On account of misconduct, dishonesty or moral turpitude, established on record.

b)      During probation period under Rule 2.8(c).

2.14          RESIGNATION

i) No employee who has been in the service continuously for a period of three months, shall resign his post unless he has given three months previous notice or pay in lieu thereof.

ii) Where an employee contravenes the provisions of clause (1) supra his unpaid wages for a period not exceeding three months shall be forfeited.

Provided that where an employee tenders resignation and makes request for lien in the bank then his/her lien shall be retained in the Bank for one year.

iii)    Resignation may be accepted by the appointing authority with immediate effect or at any time before the expiry of the period of notice in which case an employee shall be paid salary in respect of actual period spent on duty in the service.

iv)   If an employee leaves service without giving the due notice, he shall be liable to pay an amount equal to salary including allowances for the period of notice or for the period of which notice falls short and any other dues recoverable from him and the bank concerned shall be authorised to deduct these amounts from his unpaid dues including salary, allowances and gratuity.

2.15          RETIREMENT

a)         Every employee appointed in the service shall ordinarily retire on attaining the age of 58 years.  (For pre-mature retirement see Annexure VIII).

Provided that in the case of pendency of any criminal or disciplinary proceedings against any employee on the date of attaining the age of 58 years such proceedings shall continue beyond the said date of superannuation and he or she shall be subject to the decision thereof.

b)        Notwithstanding anything contained in clause (a) above any employee may be required by the Administrative Committee or permitted at this own request, to retire from the service on attaining the age of 55 years.

c)        Nothing contained in clauses (a) and (b) supra shall effect the right of the Administrative Committee to require an employee to retire on his being incapacitated for further continuance in service due to his continued illness.

Provided that before acting under this clause, the Administrative Committee shall hear the employee and also satisfy itself about the nature of his incapacity.

d)        All the powers specified for Administrative Committee under Rule 2.15 shall be exercised by the Board in respect of Addl.Managing Director (Banking)/General Manager.

2.16          DISCIPLINE AND APPEAL

Notwithstanding anything contained in any other regulation and without prejudice to such action to which an employee becomes liable under any other law or regulation for the time being in force, the employees of the common cadre shall be governed by the Discipline, Punishment and Appeal Rules attached as Annexure VI.

2.17          REFUND OF GRATUITY/SECURITY

The amount of gratuity and security shall not be paid till no dues certificates are taken from Central Bank and Apex Bank in which the official has served.

PAY ALLOWANCES AND OTHER CONCESSIONS

3.1              PAY

a) Unless anything is otherwise contained in these rules, an employee appointed to any category shall draw the basic salary in the scale fixed for the category in Annexure I.

b)         An employee finally taken on the Common Cadre shall have the right to retain his present service benefits such as pay scale, medical and otherallowances, leave rules etc.  If he finds them to be more beneficial than those provided under these rules till he considers the benefit provided under these rules to be more beneficial for him.

3.2       If an employee is promoted from a post of a lower category to a post of higher category his initial salary in the higher post shall be fixed according to the provisions of the Punjab Civil Service Rules.

3.3 a) Annual increment on first appointment or on direct recruitment or on promotion shall be allowed after the concerned employee completes the probation period successfully and passes the examination or completes the training successfully whichever is prescribed by the Administrative Committee for the category in which he is appointed.  However, the arrears of increments shall be allowed in case these conditions are fulfilled by the employee in the period specified by the Administrative Committee.

Provided that the annual increments of the employees of Central Cooperative Banks and the Punjab State Cooperative Bank shall not be with held on account of their failure to pass CAIIB Part I and Part II examinations.  These increments shall be allowed from the year/period when these actually fell due in the past and were not allowed due to the non passing of the said examination under Rule 3.3(a) of the Punjab State Cooperative Financing Institutions Service (Common Cadre) Rules 1970-71 read with Common Cadre Employees (Acquisition of Qualifications) Rules 1973.

b) The condition of passing examination or completing the training successfully shall apply to the employees taken in Common Cadre under Rule 1.10 to the extent specified by the Administrative Committee at the time of screening.

c) Subject to the provisions of sub-clause (a) and (b) supra the Annual increment in the pay scale shall accrue normally to an employee after he has completed one year’s service at a stage in the pay scale unless it has been previously withheld for reasons of unsatisfactory work or conduct etc.  The authority competent to withhold increment may withhold increment provisionally in any case where any charges with regard to unsatisfactory work or conduct are under investigation.

3.4       The following periods shall count for completing the period of one year for the purpose of grant of annual increment.

i) Period of duty in the post.

ii) All periods of earned leave with full salary except sick leave on commuted salary.

iii) ` Period of officiating service in higher post in the service provided the employee would have worked on the lower post but for his officiating promotion to the higher post.

iv) Period of suspension only if this period has been treated as duty under Rule 2.16 supra.

3.5  a) The Administrative Committee may in special cases allow initial salary at the   higher stage in the grade than normally admissible in relaxation of Rule 3.1 supra for reasons of higher qualifications or better experience to any employee on his first appointment.

       b) The Board may subject to the approval of the Registrar frame rules to grant cash awards or advance increments to an employee or employees for improving  academic or banking qualifications or doing commendable work or for meritorious service.

       c) The Management of the Punjab State Cooperative Bank/Central Coop. Bank may grant incentives/concessions to the bank employees borne on Common    Cadre strength for promoting small family norms in accordance with the instructions of the State Govt. issued from time to time in this behalf.

3.6       The sanction of increment at the time of crossing the efficiency bar shall be considered and allowed by the Administrative Committee on the basis of reports called from concerned quarters regarding the work, conduct, additional banking qualifications acquired, necessary specialised training taken as may be prescribed by the Administrative Committee.

3.7        All allowances except House Rent and Medical Allowance shall be paid to the employees, as are allowed by the Government to their employees.  Medical Allowance shall be allowed as sanctioned by the Board from time to time.  The employees would continue to receive House Rent Allowance and Medical Allowance at the rates in force before the adoption of Common Cadre till these are modified by the Board.

Provided that the employees taken on deputation from the Government or other institutions shall be paid allowances according to the terms and conditions settled with the parent body.

3.8              TRAVELLING ALLOWANCES

The travelling allowances shall be admissible to the employees in the Common Cadre as provided in Annexure VII.

3.9              PROVIDENT FUND

The employees shall be governed by Provident Fund Trust Rules framed under Employees Provident Fund and Miscellaneous Provisions Act 1952 (Annexure IV – Provident Fund Trust Rules).

BONUS AND GRATUITY

3.10 The employees on the Common Cadre shall draw bonus at the rates on which the Apex Bank decides to allow bonus.  The Central Cooperative Banks shall pay the amount of bonus in respect of the employees working in the bank within the Common Cadre on the basis of the bonus admissible to them according to the decision of the Board of Directors of that respective Central Cooperative Bank.  The difference of the amount of bonus paid to the employees and received from the Central Coop.Banks shall be borne by the Apex Bank.

3.11 The employees shall be granted Gratuity as per Annexure V and amended from time to time with the approval of Registrar, Cooperative Societies, Punjab.

The employees shall be paid Gratuity as per the provisions of the Payment of Gratuity Act 1972.

3.12          REIMBURSEMENT OF MEDICAL EXPENSES

The employees of the service shall be entitled to medical allowance as sanctioned under Rule 3.7 supra.  If an employee is admitted as an indoor patient in a hospital managed by the Government for prolonged illness, the Board may grant financial assistance as a special case.

3.13          EX-GRATIA & EMPLOYMENT FACILITIES

a) The family of an employee who dies during service of a Cooperative Bank shall be entitled for Ex-gratia grant and employment to one of the members of his family shall be given as per provisions contained in the instructions of the State Govt. issued from time to time.

b) Wherein an employee of a Cooperative Bank sustains 100% disability or is killed as a result of an attach by terrorists-crossfire between Police and terrorists, a special Ex-gratia grant shall be granted to him/his family as per provisions contained in the instructions of State Govt. issued from time to time.

                LEAVE AND JOINING TIME

4.1          Every employee shall be entitled to earned leave as is allowed to the employees of the Government.  Salary during earned leave shall be paid as admissible under the Government Rules.

a) Every employee of the Punjab State Coop. Bank Ltd., Chandigarh on Common Cadre strength shall be entitled to cash payment in lieu of un-utilized earned leave subject to maximum of 240 days on the date of retirement in consonance with the instructions of the Punjab Govt.

Provided that the authority competent to grant leave may withhold whole or part of cash equivalent to earned leave in the case of employee who retires from service on superannuation while under suspension or while disciplinary or criminal proceedings are pending against him, if in the opinion of such authority there is possibility of some money becoming recoverable from him on conclusion of the proceedings against him and on conclusion of the proceedings he will become eligible to the amount so withheld after adjustment of dues, if any.

b) In case of death of an employee of the Punjab State Cooperative Bank Ltd. and Central Coop. Banks borne on Common Cadre strength, cash payment equivalent of leave salary due to his credit subject to maximum of 240 days in accordance with the instructions of Punjab Govt. issued from time to time in this regard, shall be paid to the family of the deceased employees.

c) Every employee shall be entitled for 20 days Medical Leave for each year of service without break. The total period of such leave shall in no case exceed 6 months throughout the total service of the employee.  The medical leave shall be granted with full pay to the employee on the production of medical certificate from a Govt. Medical Officer not below the rank of Assistant Surgeon.

4.2            Competent authority may sanction casual leaves not more than 20 leaves during a calendar year and not more than 7 casual leave at a time.

4.3 SANCTION OF LEAVE

No employee shall claim leave as a matter of right.

4.4 Leaves of different nature to employees working on various posts shall be sanctioned by authorities to whom the powers are delegated by the Administrative Committee in this respect.

4.5 JOINING TIME

Joining time shall be granted to an employee as is admissible to employees of the Government.  Salary for this period shall be paid as admissible under Govt. Rules.

INTERPRETATION

AUTHORITY TO INTERPRET THESE RULES.

5.1          Notwithstanding the specific powers given to the Administrative Committee for interpretation of certain rules.  If any doubt arises at any time as to the interpretation of the rules or their application the matter will be referred to the Registrar, whose decision shall be final.

5.2              The Administrative Committee while making recruitment and promotion to the posts of various categories of employees of the Common Cadre shall observe instructions issued by the State Govt. from time to time in respect of reservation to persons belonging to Scheduled Castes and Backward Classes in the matter of recruitment and promotion.

No employee of the Coop. Institutions shall be convassing or otherwise use his influence or interfere or take part in an election to any Legislature or a Cooperative Societies registered under the Punjab Cooperative Societies Act

or a Village Panchayat.

ANNEXURE VI

RULES REGARDING DISCIPLINE, PUNISHMENT AND APPEAL

1. Notwithstanding anything contained in any other regulation and without prejudice to such action to which an employee becomes liable under any other law or regulation for the time being in force, any or all of the following penalties may be imposed for good and sufficient reason on any member of the service.:-

a)                  Censure.

b)                 Withholding of increment.

c)                  Recovery from pay or such other amount as may due to him of the whole or part of any pecuniary loss caused to the Apex Bank or Central Bank by negligence or breach of orders.

d)                 Withholding of promotion.

e)                  Reduction to a lower category or grade or to a lower stage in a time scale.

f)                   Compulsory retirement.

g)                  Dismissal from service.

Explanation:

            The following shall not constitute a penalty within the meaning of this rule:-

a)                  Termination of service or reversion to a lower category of an employee under Rule 2.9 and 2.13.

b)                 Discharge of an employee for want of vacancy or as a measure of retrenchment provided the appointment was made on temporary basis.

c)                  Reversion of an employee promoted from a lower category to a higher post, to such lower category for want of vacancy provided the promotion was made on temporary basis.

1.2       No penalty shall be imposed on any employee unless the charge or charges on which it is proposed to take disciplinary action against him have been communicated to him in writing and he has been given a reasonable opportunity of showing cause against the action proposed to be taken against him.  The authority competent to impose the penalty may, if circumstances permit, hold an enquiry into the charge or charges or cause such an enquiry to be held either by an Inquiry Officer who is on the panel of the Enquiry Officers maintained by the bank or by an officer superior to the person against whom the action is proposed to be taken for the purpose of ascertaining the truth or otherwise of the charge or charges.  If, it is decided to hold an enquiry, employee concerned shall be permitted to produce or cite witnesses on his behalf and examine the relevant documents, but shall not be permitted to engage a lawyer at the enquiry.

a)            If the punishing authority having regard to its findings on all of any of the article of charge is of the opinion that any of the penalties specified in clauses (d) to (g) of Rule 1.1 of Annexure VI of Common Cadre Rules 1970-71, a Major penalties should be imposed on the Bank employees, it shall furnish to the defendant employee a copy of the inquiry held by it and its findings on each article of charge, or where the enquiry had been held by an inquiring authority appointed by it, a copy of the report of such authority and a statement of its findings on each articles of charge together with brief reasons for its disagreement if any, with the findings of the inquiring authority.

1.3    

(a) The Managing Director, in consonance with the provisions of Para 46.6 of the Bye-laws of the Apex Bank, may transfer, suspend, charge sheet any employee borne on the Common Cadre against whom action is proposed to be taken if in his opinion the attendance of the employee on duty during the period the charges are under investigation against him is likely to affect the proceedings and inform the Administrative Committee accordingly.

(b) During the period of suspension, an employee shall be paid subsistence allowance equal to 50% of his salary with usual allowance admissible on the basis of the amount of such subsistence allowance.  The subsistence allowance shall be paid by the Apex Bank if the employees working in the Apex Bank at the time of suspension and if he is working in a Central Bank, by the Central Bank concerned.

            Provided that the Managing Director may direct the Apex Bank or Central Bank other than with which an employee was working at the time of suspension to pay subsistence allowance by recording the reasons in writing and inform Administrative Committee accordingly.

(c) If the employee placed under suspension is subsequently completely exonerated of the charges, he shall be eligible to full salary and allowances for the period of suspension and the entire period will be treated as duty.  If, however, he has not been completely exonerated of the charges, the competent authority shall specify in the order of reinstatements as to how the period of suspension should be treated and also the  amount of pay and allowance to be paid to him for such period. Salary and allowances payable under this provision shall be paid by the Apex Bank if the employee is working in Apex Bank at the time of suspension and if he is working in a Central Bank by the Central Bank concerned.

      Provided that the Managing Director may direct the Apex Bank or Central Bank other than with which an employee was working at the time of suspension to pay the salary and allowances by recording the reasons in writing and inform Administrative Committee accordingly.

1.4    

(a) The appeal against the order of the Managing Director imposing a penalty under Rule 1.5 shall lie to the Board of Directors and appeal against the orderof the Board of Directors imposing a penalty under Rule 1.5 shall lie to the Registrar, Cooperative Societies.

(b) The appeal shall be submitted within a period of 30 days from the date on which the appellant receives a copy of the order appealed against.  The appellant authority may, however, entertain any appeal within 60 days of the said date if appellant had sufficient cause for not submitting the appeal in time.

(c)           The appellate authority may after consideration of the case:-

                     i)          Set aside, reduce, confirm or enhance the penalty, or

ii)         Remit the case to the authority which imposed penalty with such directions as it may deem fit in the case.

ANNEXURE - VII

RULES FOR TRAVELLING ALLOWANCE

Gradation of employees for the purpose of Daily Allowance/TA shall be as per Punjab Govt. instructions.  However, the rate of daily allowance admissible to various employees of the bank shall be one and a half time of the rates sanctioned by the Punjab Govt. from time to time.

Where the officials have to stay in hotel and tourist Bungalows run on commercial lines they shall be reimbursed the actual hotel expenses as per their entitlement/or upto one and a half times the limits fixed by the Punjab Govt.

            The mileage allowance for journey by road on tour and on transfer of bank employees travelling allowance shall be admissible to them at the rate of Punjab Govt.

Employees will be entitled to travel by air as per instructions of Punjab Govt. issued from time to time.

Employees entitled to travel by air shall be eligible to claim actual taxi charges from the air port/railway station to the place of stay and vice versa. On the dates of the arrival and departure at places outside Punjab and further to hire taxis for visiting officers/institutions at places outside Punjab during the period of stay while on tour and such taxi charges shall be reimbursed to them in the TA bill.

ANNEXURE - VIII

THE PUNJAB COOPERATIVE FINANCING INSTITUTIONS SERVICE (PREMATURE RETIREMENT) RULES 1975.

1.         Short Title

These rules shall be called the Punjab Coop. Financing Institutions Service (Premature Retirement) Rules 1975.

2.         Commencement

They shall come into force at once.

3.         Premature Retirement

I (a) The appointing authority shall if it is of the opinion that it is in the public interest or in the interest of the institution to do so, have the right, by giving an employee prior notice in writing, retire that employee on the date on which he completes 25 years of service or attains 50 years of age or on any date thereafter to be specified in the notice.

  (b) The period of such notice shall not be less than three months.

Provided that where atleast three month’s notice is not given or notice for a period less than three months is given, the employee shall be entitled to claim a sum equivalent to the amount of his pay and allowances, at the same rates which he was drawing immediately before the date of retirement, for a period of three months or as the case may be, for the period by which such notice falls short of three months.

II.        Any employee, may, after giving atleast three months’ previous notice in writing to the appointment authority retire from service on the date on which he completes 25 years of service or attains 50 years of age or on date thereafter to be specified in the notice.

“Provided that no employee under suspension shall retire from service except with the specific approval of the appointing authority.”

4.         Gratuity

Gratuity shall be granted to an employee who retires or is required to retire under Rule 3.

5.         Over riding effect

The provisions of these rules shall have effect notwithstanding anything inconsistent therewith, contained in any other rules for the time being in force.

6.         Interpretation

If any doubt arises as to interpretation of any of the provisions of these rules, the matter shall be referred to the Registrar, Coop. Societies, Punjab.

                In the interest of the work and to bring efficiency in the functioning of the Bank, the Managing Director, in pursuance of Resolution No.32, passed by the Board of Directors dated 5.3.97, has delegated the following powers to the Establishment Officer with immediate effect.

1.                   Sanctioning of all kinds of leave from the rank of Class IV employees to the rank of Senior Accountant for a period upto two months.  In case the leave of any employee is to be rejected, the same shall be put up to A.M.D. (A) giving reasons.

2.                   Sanctioning of all kinds of increments, including Ex-gratia increments, except increments for CAIIB/H.D.C.

Non Common Cadre Rules

THE PUNJAB STATE COOPERATIVE FINANCING INSTITUTIONS

SERVICE RULES, 1958

SHORT TITLE :   These rules shall be called The Punjab Cooperative Financing Institution Service Rules, 1958.

 

DEFINITIONS:     In these rules, unless there is anything repugnant to the subject or context:-

 

a)            “Service” means the service of a Cooperative Financing Institution. 

b)            “Cooperative Financing Institution” means a State Cooperative Bank or a Central Coop. Bank or a Cooperative Union.

c)            “Board” means the Board of Directors or the Managing Committee of the Cooperative Financing Institution concerned.

d)            “Bye-Laws” means the registered Bye-Laws of the Cooperative Financing Institution concerned.

e)            “Honorary Secretary/Managing Director” means the Honorary Secretary/Managing Director of the Cooperative Financing Institution concerned.

f)             “University” means any University incorporated by law in the Republic of India.

g)            “Registrar” means the Registrar, Cooperative Societies, Punjab and includes an officer subordinate to him, not below the rank of Deputy Registrar and duly authorized by him in this behalf.

 

The Board shall determine the strength of substantive posts for the Head Office as well as for the Branch Office subject to the approval of the Registrar, the Board may from time to time, make any changes in the strength with the prior approval of the Registrar, in writing.

i)               A member of the service holding any post specified in Appendix ‘A’ may be given pay as shown therein.

ii)              a)          In case of any employee with higher qualification than as prescribed in Appendix ‘B’ a higher start may be given with the prior approval of the Registrar.

                 b)          In no case advance increment may be sanctioned to an employee without the previous approval of the Registrar.

 

                              i)    Subject to any General or special orders that may be made by the competent authority in this behalf, an authority may grant a premature increment.

 

                 c)          The employee who pass CAIIB Part I examination will be eligible for one increment and those employees who pass CAIIB Part II examination will be eligible for two additional increments. Provided further, that the employees who have completed their pay scales and have passed the said examination shall be eligible for the above increments in the master scale. METHOD OF RECRUITMENT

 

**(I) Clerks/Clerk-cum-Data Entry Operators :- The recruitment to the posts of Clerks/Clerk-cum-Data Entry Operators shall be made by direct recruitment to the extent of 85% and by promotion from Class IV employees to the extent of 15%, provided further that :-

        (a)(i)         50% posts meant to be filled up by direct recruitment shall be of Clerks having following minimum qualifications.

 

1.    Graduation

2.    Should have passed Punjabi Language examination of Matriculation standard

3.    Should be domicile of Punjab

 

        (a)(ii)        50% posts meant to be filled up by direct recruitment shall be of Clerk-cum-Data Entry Operators having following minimum qualifications.

       

                 *      1   Graduation, Diploma/Certificate (Minimum 6 months) in Computer from an   Institute having ISO Certification

                        2.    Should have passed Punjabi Language examination of Matriculation standard.

                        3.         Should be domicile of Punjab.

 

        (The post of Clerk/Clerk-cum-Typist wherever occurring in the Punjab State Cooperative Financing Institutions Service Rules, 1958 and Staffing pattern of the Cooperative Banks shall stand converted into the post of Clerk/Clerk-cum-Data Entry Operators.)**

 

Note :-      After selection of the candidates, but before appointment the selected candidate shall have to undergo 3 months training on the syllabus to be prescribed by the appointing authority subject to the approval of the Registrar, Cooperative Societies, Punjab and qualify the examination to be conducted at the end of the training. During the period of training stipend @ Rs.2500/- per month shall be given. Those selected candidates who qualify the aforesaid examination shall be appointed on probation as provided in these rules. Those selected candidates who fail to qualify the said examination shall not be appointed.

        b)      15% by promotion from Peons/Gunmen as under :-

 

1.    Matriculation pass having atleast 5 years’ service in the bank to the extent of 5% of the posts to be filled up.

2.    10+2 Class pass having atleast 5 years’ service in the bank to the extent of 5% of the posts to be filled up.

3.    Graduates having atleast 5 years services in the bank to the extent of 5% of the posts to be filled –up.

(ii)   Accountants :-

        100% by promotion having 5 years’ experience as Clerk.

(iii)  Asstt.Managers :

        100% by promotion having 3 years’ experience as Accountant.

(iv)  Drivers :

        Atleast primary standard passed possessing a driving licence for light motor vehicles.

        Five years’ experience of driving light motor vehicles preferred.

v)    Peon-cum-Chowkidars :         

        Should have passed 8th Class.

vi)   Gunman/Guard :

        Should have passed 8th Class.

vii)   The authority to recruit shall be such as is specified in the bye-laws of the Financing Institution concerned; provided that in the case of Punjab State Coop. Bank Ltd., Chandigarh the authority to recruit shall vest in the Managing Director. (Amended vide RCS Punjab letter No. Credit/CA-1/1386 dated 30.10.1996)

viii)  Before any appointment is made, the Board of Directors/Managing Directors of the Bank concerned shall secure from the applicant an affidavit to the effect that he is not related to any member of the Board of Directors of the respective Bank. All applications for appointments shall be invited with passport size photographs (duly attested).

APPOINTMENTS TO THE SERVICE

I)     All appointments to the posts specified in Appendix A shall be made by the Board subject to the production of a medical certificate of fitness from a Govt. Medical Officer not below the rank of an Assistant Surgeon.

ii)     No person shall be appointed to the service by direct recruitment if he is less than 18 years of age or more than 35 years of age. Provided further that upper age limit shall be 40 years in case a candidate is a member of schedule caste or already employed in the service of another Cooperative Institution. (Amended vide RCS Punjab letter No. Credit/CA-4/10647 dated 14.10.1998).

iii)    No person who has been convicted by any Court of law for any act of dishonesty or moral turpitude shall be eligible for appointment in the service of the bank.

iv)    No person who has been dismissed by the Govt. or any Commercial or Cooperative Bank or any other institution shall be eligible for appointment. The Board shall also secure an affidavit from the applicants to the effect while considering appointments.

v)    No employee of the Bank shall at any time be related to any member of the Board of Directors. If he happens to be so related, as defined in SO 7.17 viz (a) any one related to the person concerned, or to his wife through a common ancestor who is not more remote than a great grandfather, and (b) anyone married to a person falling under (a) then the employees shall be deemed to have been removed from the service from the same date on which this fact after having been brought to the notice of any officer of the Bank/Registrar, is brought by the latter, to the notice of such an employee.

If however, there is any dispute as to whether or not such a relationship exists the decision of the Registrar shall be final.

vi)    No bank shall appoint any person in its service who is related to another employee of the same bank except with the prior express permission of the Registrar.

vii)  Promotion of the employees in the absence of Board of Directors of Administrator in the CCBs will be considered and ordered by the Committee consisting of Joint Registrar, Deputy Registrar, Cooperative Societies, Senior Auditor (Incharge of Bank) and District Manager, CCB. In case of tie, Joint Registrar Cooperative Societies  can have the right of casting vote. 

PROBATION

i)      (All appointment to a substantive vacancy shall be on probation for one year. In case, work and conduct of any employee during the period of probation is not found satisfactory, the appointing Authority may terminated the services of such employee, if he/she has been directly recruited or revert him/her, if he/she has been promoted within the probation period or extend his/her probation period not exceeding eighteen months. (As amended vide RCS, Punjab Letter No. Credit/CA-1/3-P/RCS/Amendment/1487 dated 2.12.94)

        Provided that if anybody is found indulging in corrupt practices or in case involving moral turpitude, the employer shall have the right to dispense with his/her services. (As Amended vide RCS, Punjab letter No. Credit/CA-4/330 dated 8.1.2001).

ii)     No appeal shall lye against the order of the order of the Appointing authority terminating the services of an employee or reverting him as the case may be, as provided in clause (i) above.

iii)    On the satisfactory completion of probation period by an employee the appointing authority may appoint him to the post substantively.)

TRAINING

(I)      Any employee appointed against a substantive vacancy shall undergo such training as the Registrar may direct. During the period of training, the employee shall entitled to full pay plus the usual allowances in addition to any stipend which may be paid to him in the training center.

(ii)    Before an employee is sent for training as provided in Clause (i) above, he shall be required to sign a bond agreeing to serve the Cooperative Financing Institution concerned for atleast ___ years after the completion of training failing which, he shall pay the full charges (Pay & allowances) incurred on him by the Cooperative Financing Institution during his training period.

Provided that the terms of the bond executed by an employee under this rule by relaxed by the Board only with the prior approval of the Registrar.

1)    A specimen bond, referred to in the above rule is enclosed for necessary action. This may be got executed by the Trainee on a Non-judicial stamp pater of Rs.1.50.

2)    This bond may be treated as Appendix (E) of the Punjab Cooperative Financing Institution Service Rules.

AUTHORITY EMPOWERED TO IMPOSE PENALTY

i)            Authority empowered to impose penalty shall be the Managing Director in case of Punjab State Cooperative Bank and Board of Directors or Administrator as the case may be in the case of Central Cooperative Banks provided that in case there is no board of directors or administrators in the Central Cooperative Bank on account of any reason whatsoever the power to impose penalty shall be exercised by a committee consisting of Dy.Registrar Cooperative Societies, Audit Officer & Manager head office. (Amended vide letter No.RCS/Credit/CA4/2 dated 3.1.2003)

ii)  The provisions of the Punjab Civil Services (Punishment & Appeal) Rules, 1970 as mended from time to time shall be followed in the matter of awarding punishment to the employees.

iii) Every order awarding punishment shall be communicated to the employee concerned in writing stating the grounds on which the punishment has b een awarded.

iv) No employee in any case shall be kept under suspension for a period exceeding 6 months at a time except the cases with the prior approval of the Registrar.

v)   During the period of suspension a member shall be paid suspension allowance equal to 50% of his salary alongwith full usual allowances).

10. RIGHT TO APPEAL:

      A MEMBER OF THE SERVICE UPON WHOM THE PENALITY IS IMPOSED BY THIS PUNISHING AUTHORITY MAY WITHIN 30 DAYS FROM THE DATE OF COMMUNICATION OF THE ORDERS OF THE Punishing Authority, appeal to the Authority specified in the bye laws or Service Rules of the concerned Financing Institutions.

10(A)   SENOIRITY

i)                    The seniority of members of services after their successfully completing the probations period shall be determined from the dates of their continuous regular service and seniority lists will be prepared after providing adequate opportunity to the concerned employees by the Executive Committee. In case, the dates of joining of the service of two or more employees happen to be the same then the elder in age shall be senior. Any employee may within 60 days of the communications of seniority appeal to the Board of Directors. Provided that the period of service of any in regard to the appointment on adhoc basis shall not count towards seniority.

ii)                  Any member of the services, aggrieved by the decision of the Board of Directors.

11.       SECURITY:

            Every member of the service shall be required to furnish security as given in Appendix ‘C’.

12.       BONUS:

            A member of the service on completion of 12 months satisfactory service, may be allowed a bonus upto one month’s salary (basic pay) out of the yearly profits in accordance with the bye-laws of the Cooperative Financing Institution concerned.

13.       PROVIDENT FUND:

i)          Every member of the service shall be required from the date of confirmation to subscribe to the Provident Fund at a rate not exceeding 8% of his pay. In making calculation, fractions of a rupee of salary shall be omitted. The Cooperative Financing Institutions shall make a monthly contribution to the Provident Fund for each employee, an amount equal to the employees own contribution. An account shall be opened in the name of each member of the service contributing to the Provident Fund and amount of both, deduction & contributions shall be credited to such account every month. The Cooperative Financing Institution shall allow interest at the rate of one percent above rate of Interest allowed by it on fixed deposits.  The fund shall be controlled and administered by the Board.

i)          A temporary advance may be granted to a subscriber from the amount standing to his credit in the fund at the discretion of the Board subject to the following conditions:

A)         No advance shall be granted unless the Board is satisfied that the pecullar circumstances of the subscriber justify it, and that it will be expected on one or more of the following objects and not otherwise:-

1)         To pay expenses incurred in connection with the prolonged illness of the subscriber or any person actually dependent on him.

2)         To pay for the overseas passages only for reasons of health or education of the subscriber or any person actually dependent on him. Advances from Provident Fund may also be granted to a subscriber subject to the usual condition to meet the cost of education of himself or any person actually dependent on him in the following types of cases:-

            i)          For medical, engineering and other for an academic technical or specialized course in India, beyond the High School stage. Provided that the course of study is not  less than 3 years duration.

            ii)         For education outside India, whether for an academic, technical, professional or vocational course.

3)         To pay obligatory expenses on scale appropriate to the subscribers status which by customary usage. The subscriber has to incur in connection with the marriage, funerals or other ceremonies. Note: In cases falling under item (1) above, advances may be granted by the Board to pay debts incurred, provided an application is made within a reasonable time, shall be determined by the Board on the merits of each case.

B) The Board shall record in writing its reasons for granting the advance.

C)         Except for special reasons to be recorded in writing by the Board, and advance shall not

            1)         Exceed 3 months pay, or half the amount at the credit of the subscriber in the fund, whichever is less, except in case of a daughters marriage of the subscriber, the advance shall not exceed six months pay or

            2)         Be granted until at least 12 months after the final payment of all previous advances together with interest thereon, unless the amount already advanced does not exceed two third of the amount admissible under Sub-Clause (c)(1).

iv)        In fixing the amount of an advance, the sanctioning authority shall pay due regard to the amount at the credit of the subscriber in the fund.

v)         The rate of interest which will be charged on such advances out of the Provident Fund by the Institution, 1 percent higher than the rate allowed on the Provident Fund by the Institution.

vi)        An advance shall be recovered from the subscriber in such number of equal monthly installments as the Board may direct but such number shall not be less than twelve  unless the subscriber so elects, or in any case more than twenty four.

vii)       If more than one advance has been made to a suProvident Fund shall be payable:bscribe, each advance shall be treated separately for the purpose of recovery.

viii)      After the principal of the advance has been fully repaid, interest shall be paid thereon at the rate of one fifty percent of the principal of each month or broken portion of a month during the period between the drawal and complete repayment of the principal.

ix)        Every member of the service shall appoint a nominee to whom all moneys due on account of Provident Fund be paid in the event of subscribers death. If more than one nominee is appointed, the subscriber shall state clearly what proportion of the available balance shall be paid to each of them.

x)         a) On death of the subscriber to his duly appointed nominee or nominees or in case, no nominee had been appointed to his legal heir on the production of proof of little.

b)         To the subscriber:

            1)         On his losing the appointment through reduction of staff.

2)         On his resigning, if he has completed ten or more years of continuous service in    the Cooperative Financing Institution concerned, or.

3)         On resignation if the resignation is due solely to permanent incapacity through illness or otherwise, or.

4)         On retirement from service.

xi)        If the subscriber, with the sanction of the Cooperative Financing Institution concerned, accepts employment in any other Cooperative institution, in Punjab, his contribution and that of the Institution plus the interest on the account shall be transferred to his new employer for credit in the account of the subscriber.

xii)       If the subscriber resigns from the service after completing 5 years, but less than 10 years of continuous service with the Cooperative Financing Institution, he shall receive his own contribution and half of institutions contribution plus proportionate interest due theron. In case of displaced employees of Cooperative Financing Institution from Punjab, (Pakistan) the period of service in the Cooperative Financing Institutions from Punjab (Pakistan shall be reckoned for the purpose of this rule. 

viii)      On resigning the service before completing 5 years continuous service with Cooperative Institution or on being dismissed from service, the subscriber shall receive this own contribution plus proportionate interest thereon.

14.       LEAVE:

i)          Leave cannot be claimed as a matter of right. Willful absence without previous sanction whether in continuation of leave or otherwise shall render an employee liable for disciplinary action. Every employee shall be entitled to avail casual leave in accordance with the instructions of Punjab Govt. issued from time to time in this regard. (Amended vide letter No. Credit/CA-4/963 dated 11.10.2002.

ii)         Twenty days casual leave may be granted to an employee in a calendar year subject to the condition that not more than 7 days casual leave shall be granted at a time.

iii)        Casual leave to the Distt. Manager and Manager shall be sanctioned by the Honorary Secretary/Managing Director and in the case of other employees, by the Distt. Manager of the Cooperative Financing Institution concerned.

iv.        An employee shall earn leave at the rate of one eleventh of the period spent on duty. The period spent on duty shall include all kinds of leave except without pay leave for the purpose of calculation of earned leave. Accumulation of earned leave shall be as per institutions of an employee of Punjab Govt. issued from time to time.

(iv) (b) Subject to the balance of leave a his credit, an employee may be sanctioned earned leave.

(v) (a)Every employee of the Punjab State Coop. Bank Ltd., Chandigarh and Central Coop. Bank on Non Common Cadre strength shall be entitled to cash payment in lieu of unutilized earned leave subject to the maximum of 240 days on the date of retirement in consonance with the Instructions of the Punjab Govt.

(vi) Sick leave on production of a medical certificate from a Government Medical Officer not below the rank of an Assistance Surgeon may be granted with full pay, if leave is due. Such leave shall not exceed a period by reckoning  20 days for each year of service in the institution without break. The total of such leave shall in no case exceed 6 months throughout the total service of the employee. Provided that in case of Class IV employees, the authority competent to grant leave may accept such certificate as it may deem sufficient.

(vi)(a) The management of the Bank may grant maternity leave to the female employees borne on non common cadre strength in accordance with the provisions/instructions applicable to female employees of the Punjab Government (from time to time).

            In the interest of the work & to bring efficiency in the functioning of the Bank, the Managing Director, in pursuance of Resolution No.32, passed by the Board of Directors dated 5.3.97, has delegated the following powers to the Establishment Officer with immediate effect.

1.      Sanctioning of all kinds of leave from the rank of Class IV employees to the rank of Senior Accountant to a period upto two months. In case the leave of any employee is to be rejected, the same shall be put up to AMD(A)giving reasons.

2.      Sanctioning of all kind of increments, including, Ex-gratia increments, except increments for CAIIB H.D.C.

This issues with the prior sanction of Managing Director.

LEAVE ENCASHMENTS

            I am directed to address you on the subject cited above and to say that in pursuance of the recommendations the fourth Punjab Commission, the Governor of Punjab is pleased to decide that the admissibility limit for the encashment of earned leave at the time of retirement of Govt. employees shall stand raised from 240 days to 300 days from Ist January,1996.

vii) Leave without pay upto a maximum of one year may be granted in addition to the leave earned admissible under these rules. The admissibility of leave without pay of one year shall be for the whole period of service of an employee.

viii) Sick leave or earned leave upto a period of one month shall be granted by the Honorary Secretary/Managing Director to the employee below the rank of Manager. In excess of this period the leave shall be sanctioned by the Board.

ix) Sick and earned leave to the Distt. Manager and Manager shall be sanctioned by the Board.

x) Sick and earned leave may be cancelled by the authority empowered to grant it.

5.   TRAVELLING ALLOWANCE:

      Travelling Allowance to employees shall be paid at the rates in force for employees of the Punjab Government.

6.      RECORD OF SERVICE:

The period of service as well as the leave account of such employee shall be maintained by the Cooperative Financing Institution concerned in the form as per Appendix ‘D’. All changes affecting the rank, emoluments, transfers and other allied matters shall be noted in such record under the signatures of Honorary Secretary/Managing Director.

7.      RESIGNATION:

i)       (The appointment of a temporary employee maybe terminated by the Appointing Authority by giving one month’s notice or by paying salary for the period by which the notice falls short.)

ii)      If, any employee intends to resign from his post, he shall give one months’ notice or deposit an amount equal to his pay, etc. for the period by which his notice was short of one month.

8.      RETIREMENT:

All persons in the service shall retire on the attainment of the age of 58 years. The age of retirement may subject to the approval of the Registrar, be raised by the Board in any particular case giving reasons for doing so upto the maximum of 60 years, provided that the employee concerned is physically fit to carry on the work efficiently. Such extensions shall be from year 10 year and not for a number of years in one stretch. Registrar’s approval shall be necessary every time the extension is granted to an employee.

Provided further than Class-IV servants viz. Jamadars, Peons, Chaukidars etc. shall retire on the attainment of the age of 60 years.

19.       MISCELLANEOUS:

i) No employees shall except when generally or specially empowered or permitted in this behalf the Board, communicate directly or indirectly any documents or information which has into his possession in the course of his official duties or has been prepared or collected by in the course of such duties, whether from official sources or otherwise, to any other person institution or to the press.

ii) No employee shall have any pecuniary transaction with individuals of institutions coming contact with him in the course of his official duties or accept directly or indirectly on his behalf or on behalf of any other person, or permit any member of his family to accept any gratuity or reward from any person with whom he is concerned in the performance of his duty provided that this fule shall not apply to any borrowings by an employee, on the security to own deposits, savings, insurance policy, etc. from other institutions.

iii) No employee of the institution shall, by canvassing or otherwise, use his influence in any was an election to a public body constituted under the constitution of India or to any institution constituted under an act of the Govt. Punjab. Provided that he may cast his vote, if he is eligible to do so. IN the latter case, he shall, as far as possible, avoid giving any indication beforehand of the manner in which he intends to vote.

iv) No employee shall engage in any commercial business or pursuit either of his own account of agent for others, not act as agent for an Insurance Company or National Savings Scheme.

v. An employee shall not speculate in stocks, shares, securities, or commodities of any description provided that nothing in the regulation shall be deemed to prohibit an employee from mala bonafide investment of his own funds in such manner as he may wish.

vi) An employee who contravenes the provisions of this rule shall be liable to such punishment the Board may decide.

20.       RESERVATION TO PERSONS BELONGING TO SCHEDULED CASTE A BACKWARD CLASSES IN THE MATTER OF RECRUITMENT AND PROMOTION.

The Board, while making recruitment and promotion to the posts of various categories in Bank shall observe instructions issued by the State Government from time to time in respective a reservation to persons belonging to Scheduled Castes and Backward Classes in the matter recruitment and promotion.

21.       EX-GRATIA GRANT AND EMPLOYMENT FACILITIES:

a)      The family of an employee who dies during service of a Cooperative Bank, shall be entitled for Ex-Gratia grant and employment to one of the members of his family shall be given per provisions contained in the instructions of the State Government issued from time to time.

b)      Wherein an employee of a Coop. Bank sustains disability or is killed as a result of attack by terrorists/cross fire between policy and terrorist, a special ex-gratia grant shall be granted to him/his family as per provisions contained in the instructions of State Govt. issued from time to time.
